MEDFORD POT DISPENSARIES AND THE "FED LAW TRUMPS STATE LAW" FALSEHOOD
Medford councilman Chris Corcoran, when questioned about the city's quest to ban medical marijuana dispensaries, was quoted in the Medford Mail Tribune: "If state law trumps city law, then federal law trumps state law." No, not really. Federal law trumps state law when connected with a enumerated power of the federal government. All federal drug law, on its face, is unconstitutional. There is no constitutional power given to the federal government bestowing police power over drugs. That they do so anyway isn't a reflection of its constitutional power, but rather its supreme power to bully, jail, and kill people who oppose its extra-constitutional power grabs.
Federal statutes and other federal laws are, of course, "supreme" only if made in pursuance of the Constitution.
Here's the Supremacy Clause: "This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding."
In effect, the people have allowed themselves to falsely believe that the FED bully trumps the STATE bully, which trumps the COUNTY bully, which trumps the CITY bullies. Constitutionally, the state government of Oregon has much more police power over Medford's actions, than the federal government.
